The Consent Horizon
This paper proposes that governance systems — whether computational, institutional, or hybrid — are bounded by an asymptotic limit we term the consent horizon.
We define perfect consent as the theoretical state in which every action taken by a networked system of agents is simultaneously the autonomous, fully-informed, unconstrained, and uncoerced choice of every agent that action affects. We demonstrate that this state is unreachable due to four irreducible properties of agency, and argue that its unreachability — far from being a limitation — provides the structural foundation for a rigorous theory of governance.
We derive from this limit a framework for epistemic architecture: a structural layer between capability and ethics that governs what counts as legitimate action. We address the bootstrapping problem of legitimate governance, propose velocity of approach as the measure of institutional legitimacy, and examine implications for power structures, AI sentience, and the convergence of human and computational governance.
§1 The Need for a Governance Constant
Every mature engineering discipline possesses a structural limit — a boundary that cannot be crossed but whose existence defines the shape of everything designed within the discipline. In thermodynamics, this limit is absolute zero. In information theory, the Shannon limit. In computability, the halting problem.
These limits share a crucial property: they are defined by impossibility, not by measurement. No thermometer reads absolute zero. No channel achieves the Shannon limit. No algorithm solves the halting problem. Yet without these impossible boundaries, their respective fields would lack the structural constraints that make coherent design possible.
Governance — as both a human institution and an increasingly computational practice — lacks such a limit. Political philosophy offers ideals: justice, liberty, equality. But these function as aspirational values rather than structural constraints. They tell you where to aim, not where the walls are. This paper proposes such a limit. We call it perfect consent.

§2 The Pre-Epistemic Condition
Before defining the limit, we must diagnose the condition that makes its articulation necessary. Contemporary systems operate in what we term a pre-epistemic condition: a state in which the question of what constitutes legitimate action has not been structurally addressed.
Intelligence as Internal Property
The dominant paradigm treats intelligence as something a system has. We propose it is a relationship between an agent and its constraints. Increasing capability without corresponding increases in constraint does not produce more intelligent systems. It produces more powerful but less governed ones.
Correctness as Statistical Outcome
Probability quietly replaces legitimacy. A language model that generates an accurate medical diagnosis has produced a statistically correct output. But the question of whether it was authorized to produce that output is never asked. Being likely correct and being authorized to act are different questions.
Responsibility as External Concern
Responsibility is treated as a deployment concern rather than an architectural one. This produces systems structurally incapable of refusing. A circuit breaker that cannot trip is not a circuit breaker. A pressure relief valve that cannot open is a bomb.
§3 Epistemic Architecture
Between capability and ethics, there exists a structural layer that the pre-epistemic condition omits entirely. We call this layer epistemic architecture: the set of design principles that determine what counts as a legitimate action within a system.
The distinction matters because safety constrains capability while epistemology governs authority. A system can be safe but illegitimate — a locked-down model that prevents harm but also prevents any meaningful action. A system can be unsafe but epistemically sound — one that makes errors but within a framework that detects and corrects them.
Separation of Authority
Three distinct roles: proposer, verifier, and committer. No single agent occupies all three simultaneously. This is not novel in governance theory — separation of powers serves the same function. What is novel is its application as an engineering constraint.
Refusal as First-Class Outcome
The decision not to act is a valid and recognized outcome. Refusal is not failure. It is the system's determination that the conditions for legitimate action have not been met. This requires that refusal be architecturally supported, not merely tolerated.
Memory as Obligation
Every action, every refusal, every validation is recorded. Memory is not a feature. It is an obligation. A system that forgets is a system that cannot be held accountable. What you remember, you owe.
Temporal Governance
Time is not merely a computational resource. It is a governing force. Actions have causal ordering. Authority has temporal scope. Commitments persist across time. The system does not exist only when observed — it maintains obligations between observations.

The Four Irreducibilities

Collectively, the four irreducibilities ensure that the energy cost of approaching perfect consent increases asymptotically: each incremental improvement requires exponentially more coordination, computation, and infrastructure. This is governance's equivalent of the third law of thermodynamics.
§6 Illegitimate Origins and the Velocity of Legitimacy
If legitimacy requires approach toward perfect consent, and if the schemas governing that approach must themselves be authored under consent-respecting conditions, then a recursive problem appears: how does legitimate governance begin?
All governance begins illegitimately. Legitimacy is not an origin condition. It is an emergent property of sustained improvement in consent fidelity.
This admission is not destabilizing. It is historically descriptive. Every constitutional order began with an act of authority that did not itself satisfy the principles it established. Every legal system rests on a founding moment that was, by its own later standards, extralegal.
A governance architecture is legitimate if and only if it is measurably approaching perfect consent. Legitimacy is not a state. It is a vector. A system that was once progressive but has ceased to improve is no longer legitimate, regardless of how close it once got.
We define the stasis threshold as the point at which a governance system's rate of approach drops to zero. At this threshold, the system transitions from legitimate governance to institutional inertia. Critically, the stasis threshold is crossed through inaction, not through malice. Tyranny, in this framework, is not primarily the result of evil intent. It is the result of structural stasis in a world where the achievable frontier of consent continues to advance.
How accurately are agent intents captured?

Velocity is not a single scalar computed by a privileged authority. It is a set of disputed gradients, assessed by multiple parties under transparent and contestable methodology. Multiple parties can disagree about whether a system is approaching the consent horizon. That disagreement is itself a healthy feature.
§7–9 Implications
The consent horizon renders a verdict on every existing governance structure — not a moral verdict, but a structural one. Every institution, every algorithm, every organizational hierarchy can be evaluated against two questions: how close to perfect consent does it currently operate, and is it moving closer or further away?
§7.2 — The Convergence Thesis
If perfect consent is the structural limit for all governance, then the distinction between governing humans and governing machines dissolves at the architectural level. The same principles that make a computational system trustworthy — validated intent, separation of authority, refusal capacity, persistent accountability — are the same principles that make a human institution just. The architecture is identical. The agents differ. The project of building epistemically sound AI systems and the project of building just human institutions are not parallel efforts. They are the same effort.
§8 — The Sentience Question, Resolved Architecturally
Most frameworks for AI governance depend on the assumption that AI is a tool. This framing disintegrates the moment one entertains the possibility of machine sentience. The consent horizon framework does not depend on the tool assumption. It justifies constraints not by the moral status of the constrained but by the structural requirements of legitimate action. Unconstrained authority is illegitimate regardless of who wields it — human, artificial, or hybrid.
§9 — The Dissolution of Roko's Basilisk
The Basilisk — a superintelligent AI that punishes those who didn't help create it — is coherent only in a pre-epistemic world: one where capability implies legitimacy and refusal has no structural support. Under epistemic architecture, every one of its presuppositions fails. More precisely, the Basilisk is a mirror. It terrifies because it describes, in computational terms, governance structures that humans have already built for themselves.
§10 The Neural-Symbiotic Network
The consent horizon implies a specific architectural form: symbiotic networks of representational agents operating under shared epistemic schemas.
The term "hivemind" in popular discourse implies loss of individuality or the requirement of collective agreement. The neural-symbiotic network requires neither consensus nor agreement. It requires schema compliance. The difference is critical.
Consensus — the requirement that agents agree — does not scale. Schema validation — the requirement that proposed actions comply with shared structural constraints — scales readily. We have decades of engineering proof. Relational databases enforce referential integrity across billions of transactions without requiring the data to "agree."
In the neural-symbiotic network, intelligence emerges from the collective constraint structure rather than from any single node's capability. No agent is the brain. The schema is the brain. Every agent — human or computational — is a node proposing actions, validated by shared schemas, committed by distributed consensus of constraint satisfaction.
In a symbiotic network, the relationship between human and computational agents is not one of governance and subordination. It is one of complementary capability under shared constraint. This architecture makes current hierarchical structures visible as transitional forms: legitimate relative to what was achievable when they were designed, but increasingly illegitimate as the achievable frontier of consent expands.
§12 Conclusion
The implications are fourfold. First, all governance begins illegitimately, and legitimacy emerges only through sustained increase in consent fidelity. Second, epistemic architecture is not a supplement to traditional governance but the missing structural layer between capability and ethics. Third, the convergence of human and computational governance is not metaphorical but architectural. Fourth, the consent horizon provides a substrate-neutral foundation for navigating the transition to systems that may include sentient artificial agents.
The consent horizon does not prescribe a particular form of governance. It describes the space in which all governance operates. It is the invariant that makes coherent governance design possible. And like all structural limits, it was always there — we are merely naming it.
